Section 20 - SMS/MMS Mobile Message Marketing Program Terms and Conditions

Overview of the Program: Oxford offers a mobile messaging program (the “Program”), subject to these Mobile Messaging Terms and Conditions and Privacy Policy (the “Agreement”). By opting in or participating, you agree to these terms, including binding arbitration for dispute resolution. This Agreement applies only to the Program.

User Opt-In: Users opt into the Program through affirmative actions like online forms. By participating, you agree to receive marketing mobile messages at the provided phone number. Consent isn't required for purchases. Message and data rates may apply.

User Opt-Out: To opt out, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message. You may receive a confirmation message. Oxford isn't liable for unsubscribe requests not following specified keywords. Opt-out only through provided methods.

Program Description: Expect messages on marketing, promotions, payment, delivery, and sale of digital/physical products, services, and events, including checkout reminders.

Cost and Frequency: Message and data rates may apply. You'll receive messages periodically, with varying frequency. The Program involves recurring mobile messages.

Support: Text “HELP” for support or go to www.oxfordusahome.com, click "Contact Us" on top of the page, fill up the form and select General Enquire from the reason field. The Customer Service representative will contact you within 48 hours. This isn't an opt-out method.

MMS Disclosure: The Program sends SMS TMs (terminating messages) if your device doesn't support MMS.

Disclaimer of Warranty: The Program is offered "as-is" and may not work in all areas or after changes by your carrier. Oxford isn't liable for message delays or failures.

Participant Requirements: You need a two-way messaging device, a participating carrier, and text messaging service. Check your phone capabilities for text messaging instructions.

Age Restriction: You must be 13+ to use the Platform. If 13-18, you need parental/guardian permission.

Prohibited Content: Don't send prohibited content, including fraud, objectionable material, pirated software, unlawful products, and more, as per Applicable Law.

Dispute Resolution: Disputes will be resolved by arbitration in Texas, USA, following AAA rules. Claims must be brought individually, not in a class proceeding.

State-Specific Compliance: For residents of Florida, Washington, and Oklahoma, specific compliance details are provided below:

Florida: We aim to adhere to the Florida Telemarketing Act and the Florida Do Not Call Act for Florida residents. Compliance is determined if, during opt-in to the Program, your shipping address is in Florida or the phone number's area code used for opt-in is a Florida area code. If you don't meet these criteria, you agree the Florida Telemarketing Act and the Florida Do Not Call Act don't apply, and you won't claim Florida residency unless you notify us otherwise. For Florida residents, mobile messages in direct response to your requests won't be considered a “telephonic sales call” or “commercial telephone solicitation phone call” under Florida Statutes Section 501.

Washington: We strive to comply with commercial telephone solicitation requirements outlined in the Revised Code of Washington (RCW) for Washington residents. Compliance assumes your area code during opt-in is a Washington area code.

Oklahoma: We endeavor to comply with the Oklahoma Telephone Solicitation Act of 2022 for Oklahoma residents. Compliance is assumed if the area code used during opt-in is an Oklahoma area code. You agree not to claim Oklahoma residency unless notifying us otherwise. For Oklahoma residents, mobile messages in direct response to your requests won't be considered a “telephonic sales call” or “commercial telephone solicitation phone call” under Oklahoma Statutes Title 15.

Miscellaneous: You warrant having the right to agree to these terms. Failure to exercise rights doesn't waive them. Unenforceable provisions will be limited. Updates communicated, and your continued participation implies acceptance of modifications.
